| We often hear people complaining about the bad management in some communities: cars are broken or stolen or nobody cares about the environment in their communities.Residents often go to property management company for solving these problems. Unfortunately, the property management company will say they are not responsible for everything. However, these conflicts may be solved in light of new property management regulations.
Liu Xiaoming,the director of Law Commission of Ningbo People’s Congress, says that what is important is that both parties should be specific in some articles as to how to solve conflicts in the community, including how to deal with car accidents. There is a problem of cost. For instance, the property management company which is given more tasks will have to employ more hands, all these should be written clearly in their contract.
Once there is a conflict, flat owners in a community can solve the problem according to the contract. What’s more, the contract can even demonstrates who is responsible for solving the problems involved.
Liu Xiaoming says that when flat owners are involved in a conflict, they can resort to neighborhood committees or property management company in their community.
The new Property Management Regulaitons also stipulates that flat owners in a community enjoy the priority of parking their cars in the community. The property management company are not entitled to sell, bestow or lend parking space to non-community persons or organizations if flat owners are still in need of it. Neither real estate companies now property management companies can determine that any parking space is just for sale, not lease. Parking fee should be counted individually and should not be listed in property management fee. Any violation to these regulations may lead to at most fine of 200,000 Yuan. |
